Some local governments in Kentucky have enacted the Uniform Residential Landlord and Tenant Act (URLTA). This law details both rights and responsibilities for landlords and their tenants.
For example, it requires that landlords “keep the premise fit and in a habitable condition,” maintain utilities and any other services they provide, and “keep common areas clean and safe,” just to name a few. Tenants are responsible for things like paying rent on time, abiding by housing and building codes and not damaging the property.
Housing advocates say shortage of homes jeopardizes tenants’ rights
Tenants’ rights advocates have argued that the law should apply to landlords throughout the state. They’re continuing to put pressure on current state lawmakers to expand the law, which dates back to the 1980s, so that all Kentucky landlords must comply with it.
The head of the Homeless and Housing Coalition of Kentucky says that as the shortage of housing throughout the state grows, it’s more important than ever to ensure that all tenants have codified rights and protections, including protection from retaliation if they report a building code violation to the appropriate government entity.
Advocates are also working to get dismissed evictions expunged
The group is also working to get a law in place to expunge evictions if they’re dismissed by the court. While over 40,000 evictions are filed annually in Kentucky, some 80% are dismissed. However, a dismissed eviction can still be seen on a background check, which can prevent people from getting housing or even jobs in some cases.
The group’s executive director says, “A lot of landlords will have a strict no-eviction policy. If you’ve had an eviction within the last five years, seven years or even forever, they will not accept your application for housing.”
